SailGP with B&G Sweepstakes Terms and Conditions
NO PURCHASE NECESSARY. PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCE OF WINNING. OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES, DISTRICT OF COLUMBIA, AND PUERTO RICO WHO ARE 18 YEARS OF AGE OR OLDER. VOID WHERE PROHIBITED BY LAW.
1. Promotional Period. Promotion commences at 10:00 a.m. PST on March 10, 2022 and ends at 5:00 p.m. PST on March 14, 2022 (“Promotional Period”). Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Eligibility. Entry is only open to legal resident of the United States, District of Columbia, and Puerto Rico who are 18 years of age or older as of the date of entry and who comply with these Terms and Conditions. Employees (and their immediate families, such as spouses, parents, children, and siblings) of the promoter (Navico, Inc.) and agencies associated with this promotion are ineligible to enter. The entrant must be an active member of the B&G online community (electronic newsletters) at time of drawing. Void where prohibited by law and subject to all federal, state and local laws.
3. How To Enter. To enter online, visit the competition page via the following link: https://www.bandg.com/sailgp/san-francisco-asa-2022/. After completing the required fields, click “ENTER” to submit your entry. Entry form must be submitted during the Promotional Period. Failure to follow these instruction and/or incomplete submissions will void your entry. Once submitted, an Online Entry cannot be deleted, canceled or modified. Enter using only an e-mail address subscribed and registered in your name. In the event of a dispute as to online entries submitted by multiple individuals using the same e-mail account, subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.
4. Conditions of Entry. Limit of one (1) entry per person, per e-mail address and per mailing address accepted for this promotion. Use of any robotic, automated, programmed, or similar entry method or entering more than the number of times permitted will void all such entries and result in disqualification. Any entry not in compliance with the above and which does not meet the requirements of these Terms and Conditions will be disqualified. All entries submitted become the property of the Promoter and will not be acknowledged or returned.
5. Random Drawing. One winner will be selected via random drawing. The odds of winning a prize will depend on the number of eligible entries received. B&G’s decisions are final in all respects.
B&G reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who B&G has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardize fair and proper conduct of the promotion. Errors and omissions may be accepted at B&G’s discretion.
6. Prize and Approximate Retail Value. Each winner will receive a pair of two (2) VIP tickets to the 2022 Mubadala United States Sail Grand Prix event in San Francisco, California. The prize has an estimate retail value of $2,000 USD. The prize is as stated and nothing else is included. All other costs and expenses in taking up the prize, including but not limited to travel, food, drink, spending money as required, are the winners’ own responsibility. For the avoidance of doubt, all gratuities, fees, taxes, ground transportation, hotel incidentals or any other charges are not included in prize and are the sole responsibility of the winner. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash. The winner’s entry and acceptance of the prize offered constitutes permission (except where prohibited) for the Promoter to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state or province), in all forms of media, in perpetuity, without notice or further compensation.
7. Winners and Shipping. Winners will be announced through Sponsor’s social media channels and will be notified directly via email. For privacy: Social media will only post the winner’s first name and last initial. Prizes will be shipped to winner’s residence after shipping information is verified via email. Sponsor reserves the right to require prize winners to sign and return an Affidavit or Eligibility and Liability/Publicity Release as a condition of receiving the prize. BY ACCEPTING THE PRIZE, THE WINNER AGREES TO RELEASE AND HOLD HARMLESS NAVICO, INC. AND ITS AFFILIATES OR SUBSIDIARY COMPANIES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AGENTS, SUCCESSORS, ASSIGNS AND INSURERS FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN OR RECEIPT OR USE OF THE PRIZE.

8. Unclaimed or Unavailable Prizes. If for any reason the winner does not take the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and promoter may, at its discretion, select an alternate winner through a random drawing. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
9. Data Processing and Privacy. Entrants agree that personal data including, but not limited to, name, mailing address, phone number, and/or email address will be collected, processed, stored and otherwise used for the purposes of conducting and administering this promotion. This data may be transferred into or out of the United States. Further, this data may also be used by Promoter to verify an entrant’s identity, postal address and telephone number in the event an entrant qualifies for any applicable prize as well as to deliver the applicable prize.

10. Email Communications. By joining the B&G community, you, the entrant, understand you will receive email communication from the promoters (B&G), including marketing communications such as product information, special offers, newsletters, trip and event invitations.
11. Entrant Warranties. Each entrant represents and warrants (a) that his or her entry does not violate any federal, state, provincial or local law, rule or regulation, or any other applicable law where ever found; (b) that his or her entry is not defamatory, slanderous or libelous or portray any person or persons in a false light; (c) that the entry, or the means of its transmission, does not contain any virus, bugs or other deleterious material, and (d) that the entrant will follow these Terms and Conditions. To the maximum extent permitted by law, each entrant agrees that he or she shall and does indemnify and agrees to keep indemnified Promoter at all times from and against any and all liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the entrant and/or a breach by entrant of any warranty or rules set forth herein. To the maximum extent permitted by law, each entrant agrees to defend, indemnify and hold harmless promoter, its affiliates and each respective directors, officers, employees and agents from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of, relating to or accruing from (a) any material uploaded or otherwise provided by the entrant that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property or proprietary right of any person or entity or defames any person or violates their rights of publicity or privacy, (b) any misrepresentation made by the entrant in connection with the promotion; (c) any non-compliance by the entrant with these Terms and Conditions; and (d) claims brought by persons or entities, other than Promoter, arising from or related to the entrant's involvement with the promotion.
12. CAUTION. ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
13. NOT AN OFFER OR CONTRACT OF EMPLOYMENT. Under no circumstances shall the submission of an entry into or participation in this promotion or the awarding of a prize be construed as an offer or contract of employment with either Promoter or any participating entity or person. Each entrant acknowledges that he or she has submitted his or her entry voluntarily and not in confidence or in trust. Each entrant acknowledges that no confidential, fiduciary, agency or other relationship or implied-in-fact contract now exists between entrant and Promoter or any other participating entity or person and that no such relationship is established by submission of an entry under these Terms and Conditions.
14. Additional Terms and Conditions. By entering the promotion, winners and entrants agree to release, discharge, indemnify and hold harmless the Promoter and its respective affiliates, agents, officers and employees, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use or misuse of any prize offered, or participation in this promotion to the fullest extent permitted by law. This promotion is void where prohibited. Entrants acknowledge that Promoter and its agents have not made any representation, warranty or guaranty, in whole or in part, in law or in fact, relative to the prize. Winners may be required to complete a declaration of eligibility and, to the extent permitted by applicable law, a liability release and a publicity release, which must be returned within time period specified by Promoter, or an alternate winner may be selected.
15. Right to Cancel. If, for any reason the promotion is not capable of running as planned or is compromised in any way, including infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt, impair or affect the administration, submission of entries, security, fairness, integrity, proper play or conduct, Promoter reserves the right to cancel, terminate, modify or suspend the promotion.
16. Disclaimer. BY PARTICIPATING IN THIS PROMOTION YOU AGREE THAT NAVICO, INC. MAKES NO WARRANTY, REPRESENTATION, OR GUARANTEE OF ANY KIND TO ANYONE, EXPRESSED OR IMPLIED, IN FACT OR IN LAW, RELATING TO THIS PROMOTION AND/OR THE PRIZES PROVIDED PURSUANT THERETO. Promoter is not responsible for any electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, and disclaims any liability for theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind.
NAVICO, INC. SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS PROMOTION OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE (INCLUDING ANY TRAVEL/ACTIVITY RELATED THERETO).
17. Choice of Law/Forum. By entering this promotion, you, as the entrant, agree that these Terms and Conditions and any dispute or claim arising out of or relating to these Terms and Conditions or this promotion shall be resolved individually, without resort to any form of class action, and exclusively by the U.S. District Court for the Northern District of Oklahoma sitting in Tulsa County. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the entrant and Promoter in connection with this promotion, shall be governed by, and construed in accordance with, the laws of the State of Oklahoma without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of Oklahoma. If any provision(s) of these Terms and Conditions are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
18. Release. By accepting the prize, the winners agree to release and hold harmless the Navico, Inc. and its respective parent companies, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in this promotion or receipt or use or misuse of any prize.
